Right of Withdrawal for Consumers

Definition of Consumer

A consumer is any individual entering into a legal transaction for purposes that are primarily outside their commercial, business, or independent professional activities.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) calendar days without giving any reason.

The withdrawal period begins from the date:

  • on which you, or a third party designated by you (other than the carrier), have taken possession of the goods, if you ordered one or more items delivered as a whole;

  • on which you, or a third party designated by you (other than the carrier), received the last item, if you ordered multiple items delivered separately;

  • on which you, or a third party designated by you (other than the carrier), received the last part or piece, if you ordered goods consisting of multiple parts or pieces.

For the avoidance of doubt, delivery is deemed to have taken place on the date the carrier records delivery to the address or delivery location provided by you, including delivery without signature, delivery to a secure drop-off location, or delivery to a neighbour, in accordance with the carrier’s standard procedures.

Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us (MCS Formulas B.V., email: [email protected]) of your decision to withdraw from this contract by means of a clear statement. You may use the sample withdrawal form provided below. To meet the withdrawal deadline, it is sufficient for you to send your notification before the expiry of the fourteen (14) calendar day withdrawal period.

Return of Goods After Withdrawal

After notifying us, you must return the goods without undue delay and no later than fourteen (14) calendar days.

  • The customer is responsible for arranging the return shipment.
  • The direct cost of returning the goods is entirely the responsibility of the customer.
  • MCS Formulas B.V. does not provide return labels and does not reimburse return shipping costs.

The customer bears the full risk of loss, damage, or delay during the return shipment. We strongly recommend using a trackable and insured shipping method.

Condition of Returned Goods

Returned goods must be:

  • unopened;
  • unused;
  • in original condition and packaging.

For health and hygiene reasons, opened or unsealed products are not eligible for return or refund (in accordance with EU Directive 2011/83/EU, Article 16).

If returned goods show signs of use, damage, or are not in resalable condition, we reserve the right to:

  • refuse the refund; or
  • issue a partial refund reflecting the diminished value.

Refunds

Refunds are processed within fourteen (14) calendar days from the date we are informed of your withdrawal. However, we may withhold the refund until the returned goods have been received and inspected. No refunds are issued without return and inspection of the goods, unless required by applicable law. Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed.

  • We will refund the cost of the goods and the least expensive standard delivery option offered at the time of purchase.
  • Any additional cost resulting from selecting a more expensive shipping method (e.g. express shipping) will not be refunded.

For customers outside the European Union:

  • original shipping costs may not be refundable unless required by applicable law.

Import Duties and International Orders

For orders shipped outside the European Union:

  • import duties, VAT, and customs fees remain the responsibility of the customer;
  • if such costs were paid by MCS Formulas B.V., only documented amounts may be deducted from the refund.

For return shipments:

  • any customs charges, delays, or issues during return transit remain the responsibility of the customer;
  • incorrect customs declarations may result in additional costs or failed returns.

Unclaimed, Refused, or Undeliverable Shipments

If a shipment is:

  • unclaimed;
  • refused; or
  • returned due to failed customs clearance,

it will be treated as an unclaimed return.

In such cases, we reserve the right to deduct:

  • outbound shipping costs;
  • return shipping costs;
  • any customs or handling fees incurred.

Transaction Fees and Non-Statutory Refunds

This provision does not affect statutory consumer rights under applicable EU law.

For orders not subject to a statutory right of withdrawal, including orders placed by customers outside the European Union, or refunds granted as a gesture of goodwill, MCS Formulas B.V. reserves the right to deduct demonstrable payment processing and transaction fees from the refunded amount. For example, for high-value orders or in cases of repeated order placement and cancellation, such fees may be withheld. Any deducted fees will correspond to actual costs incurred, and proof of such costs will be provided upon request.

Practical Considerations for International Returns

Due to the nature of international shipping, customers should be aware that:

  • return shipping costs may be significant;
  • combined shipping, customs, and transaction costs may represent a substantial portion of the order value.

We recommend considering these factors before initiating a return.

Important Return Instructions

To ensure proof of return and shipment tracking, we strongly recommend using a trackable shipping service. Once the return has been dispatched, please email us the tracking number.

If the return shipment is sent from outside the European Union, we strongly recommend that the package be clearly declared as “returned goods” on the customs documentation. This helps reduce the risk of customs delays or additional import charges.

Please note that delays, charges, or issues arising from incorrect or incomplete customs declarations remain the responsibility of the sender.
